1. About these terms
These terms govern your use of theprizedrawcompany.com (including quiz.theprizedrawcompany.com) and any consultancy services provided by The Prize Draw Company.
The Prize Draw Company is a trading name of Simon Walker, a sole trader registered in England.
By using this website or engaging our services, you agree to these terms.
2. What we do
We provide consultancy services to help organisations run prize draws. This includes strategy, audience mapping, prize selection guidance, page building guidance, marketing planning, and post-draw support.
We are a consultancy. We are not the prize draw operator. The organisation running the draw is responsible for ensuring their prize draw complies with the Gambling Act 2005 and any other applicable regulations.
3. The readiness quiz
The quiz at quiz.theprizedrawcompany.com provides a personalised readiness score and recommendation based on your answers. It is designed to help you understand whether a prize draw could work for your organisation.
The quiz is free, requires no account, and the results are indicative only. They do not constitute professional advice or a guarantee of outcomes.
4. Consultancy services
When you engage us for consultancy work, we will agree the scope, deliverables, timeline, and fees in writing before work begins. This written agreement forms the basis of our contract with you.
Fees are payable as agreed. Payment is processed via Stripe. All fees are quoted in GBP and are exclusive of VAT unless stated otherwise.
5. No guaranteed outcomes
We provide expertise, strategy, and guidance. We do not guarantee specific fundraising or income results. The success of a prize draw depends on many factors outside our control, including your audience, prize, marketing execution, and timing.
Where our fees include a commission element, commission is calculated on actual funds raised as recorded by the prize draw platform.
6. Intellectual property
All materials, templates, frameworks, and content we provide as part of our consultancy services are our intellectual property unless otherwise agreed in writing.
You are granted a licence to use these materials for the purpose of running your prize draw. You may not resell, redistribute, or share them with third parties without our written consent.
7. Your responsibilities
- Providing accurate and timely information about your organisation, audience, and objectives.
- Ensuring your prize draw complies with the Gambling Act 2005 and any other applicable laws and regulations. We provide guidance on compliance, but legal responsibility sits with the organisation running the draw.
- Obtaining any necessary permissions for prizes, images, logos, and other materials used in the draw.
- Responding to communications in a timely manner to keep projects on track.
8. Limitation of liability
To the fullest extent permitted by law, our total liability to you for any claim arising from our services shall not exceed the total fees paid by you for those services.
We shall not be liable for any indirect, consequential, or incidental losses, including loss of revenue, loss of data, or loss of opportunity.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
9. Cancellation
Either party may terminate a consultancy engagement by giving written notice. If you cancel after work has begun, fees for work already completed are non-refundable.
For digital products (such as the Blueprint), consumer distance selling regulations apply. You have 14 days from purchase to request a refund, provided the product has not been fully delivered or accessed.
10. Data protection
We take your privacy seriously. Our Privacy Policy explains what data we collect, why, and how we use it.
Where we process personal data on your behalf as part of consultancy work (for example, audience data you share with us), we will handle it in accordance with UK GDPR and will not use it for any purpose other than delivering your project.
11. Third party platforms
Prize draws are hosted on Crowdfunder UK. We are not responsible for the operation, availability, or policies of Crowdfunder or any other third party platform. Your use of those platforms is subject to their own terms and conditions.
12. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to these terms
We may update these terms from time to time. The "last updated" date at the top of this page will always reflect the most recent version. Continued use of the website or services after changes constitutes acceptance of the updated terms.
